California issues emergency cannabis rules // Bureau of Cannabis Control

“California’s three state cannabis licensing authorities announced [Thursday] that proposed emergency licensing regulations for commercial medicinal and adult-use cannabis have been posted online and are available to the public for review.

“The Department of Consumer Affairs’ Bureau of Cannabis Control, Department of Public Health’s Manufactured Cannabis Safety Branch, and Department of Food and Agriculture’s CalCannabis Cultivation Licensing Division each developed the new regulations to reflect the law defined in California’s Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA).

“The licensing authorities expect the emergency regulations to be effective in December 2017. The implementation date for the issuance of the state commercial cannabis licenses remains the same: January 1, 2018. However, California will only be able to license those businesses that are in compliance will all local laws.”

“The [County Board of Supervisors] will next vote on the proposal Nov. 28. That means the earliest San Francisco could now allow outlets to begin selling recreational cannabis is Jan. 5, four days after it becomes legal statewide.

“The board remains stuck on how to create citywide planning rules for where new cannabis outlets can open, one of the most politically contentious aspects of the proposal.”

Taxing adult use and medical at the same rate would be intended to prevent the lower priced (non-taxed) medical product from “leaking” into the recreational market.

“The former chair of the BerkeleyMedical Cannabis Commission, Daniel Rush, has been sentenced to 37 months in prison for money laundering and fraud that occurred between 2010 and 2015. Rush also served as an organizing coordinator for the United Food and Commercial Workers Union’s unofficial cannabis division.”

“According to a Forbes report by cannabis journalist Tom Angell, Sessions told members of Congress during a House Judiciary Committee oversight hearing [Tuesday] that, ‘Our policy is the same, really, fundamentally as the Holder-Lynch policy, which is that the federal law remains in effect and a state can legalize marijuana for its law enforcement purposes but it still remains illegal with regard to federal purposes.’”
